SPACE ODDYSEA
S McCabe BIM Solutions Ltd. publishing as SMCGaming
1. Who we are
Space Oddysea is published by S McCabe BIM Solutions Ltd. under its gaming brand, SMCGaming. In this policy, “we”, “us” and “our” mean S McCabe BIM Solutions Ltd. We are the controller of personal information processed for the purposes described below. This policy covers the game and communications you send us about it.
Country: United Kingdom
2. The first release
Space Oddysea is a single-player virtual reality game for Meta Quest. You do not need to create a separate SMCGaming account. The game has no in-game advertising, public chat, multiplayer service or public leaderboard. We do not sell players’ personal information or use it for targeted advertising.
3. Gameplay settings and progress
The game stores settings such as audio levels and aim assistance, together with completed-wave and wave-selector unlock information, on your headset. This lets the game remember your preferences and available waves. Current gameplay information is also processed while a run is taking place. We do not operate a separate SMCGaming cloud service for saving runs.
Device or Meta backup features may separately back up or restore local game data, depending on your platform settings. Such backups are managed under the platform’s terms and privacy information.
4. Virtual reality inputs
The game uses headset position and orientation, controller inputs and related tracking information supplied by the device to display the cockpit and operate the controls. These inputs are processed during gameplay. We do not use them to identify you, create biometric identity profiles or build advertising profiles, and do not send raw movement recordings to an SMCGaming server.
The game does not provide microphone recording, voice chat, camera capture, eye-tracking or face-tracking features. Meta’s separate processing of device and tracking information is described in its own privacy notices.
5. Technical diagnostics
The game is built with Unity. Unity Diagnostics processes technical information on our behalf to help identify crashes, errors and reliability problems. This can include an installation-specific identifier, crash and error reports, relevant device and software details, and configuration metadata. Reports may be made available to us through Unity’s diagnostic tools. We use them to investigate faults, protect the game’s reliability and improve stability, not for advertising.
Unity’s Game Player and App User Privacy Policy explains its relevant services: https://unity.com/legal/game-player-and-app-user-privacy-policy.
If you want access to or deletion of diagnostic information associated with your installation, contact us. We may need limited technical information to locate the relevant records and will work with the service provider where necessary.
6. Information you send to us
If you contact us for support or a privacy request, we process your email address, any name you provide, your message and any attachments or technical information you choose to share. We use this information to respond, investigate the issue and keep an appropriate record of how it was handled. Please avoid sending payment-card details, passwords or unnecessary sensitive information.
You do not have to send us a support message to play. If you do not provide enough information about an enquiry, we may be unable to investigate or reply effectively.
7. Why we process information
Where UK data protection law applies, we rely on the following legal bases, as appropriate: performing our contract with you for processing necessary to provide the game; our legitimate interests in responding to support requests, maintaining a reliable and secure game, and handling complaints; and compliance with legal obligations when responding to valid regulatory or legal requirements.
For legitimate-interest processing, we consider its necessity and its effect on your rights. You may object to this processing by contacting us. Where a particular activity legally requires consent, we must obtain that consent before carrying it out; this policy does not itself provide or replace consent.
We do not make solely automated decisions about you that produce legal or similarly significant effects.
8. Sharing and platform services
We may use service providers, including Unity for diagnostics and our email provider for support correspondence, to process information for the purposes described here. We may also disclose information where required by law or reasonably necessary to establish or defend legal rights, using only what is relevant.
Meta separately operates the Quest device, Meta account, store, payment and platform services. Meta may process account, purchase, device, usage and diagnostic information under its own notices. Buying the game does not give us your payment-card details. Requests concerning information held independently by Meta should be directed to Meta, although you can contact us about information processed by us or on our behalf.
Meta privacy information: https://www.meta.com/legal/privacy-policy/.
9. Retention and international processing
Local settings and wave-unlock records remain until the game’s app data is removed or reset, subject to device and backup behaviour. Support correspondence is retained while an issue is being dealt with and afterwards only as reasonably necessary for follow-up, complaint handling, legal requirements or the establishment or defence of claims. The period depends on the nature of the matter and any applicable obligations.
Diagnostic information is retained in accordance with the configured service retention period and the need to investigate technical issues. It is not kept indefinitely merely because you played the game.
Service providers may process information outside the United Kingdom. Where we arrange a restricted international transfer, we use the safeguards required by applicable law, such as an applicable adequacy decision or appropriate contractual safeguards. Contact us for information about safeguards relevant to your data. Meta’s independent international processing is covered by its own privacy notices.
10. Deletion and your privacy rights
Any player, wherever they live, can email our privacy contact to request deletion of personal information held by us or on our behalf. There is no charge for making a deletion request. We may reasonably verify a request before acting. If a legal obligation or the establishment or defence of a claim requires us to retain specific information, we will explain the reason and limit what is retained.
To remove local settings and unlock records, delete the game’s app data. This resets those preferences and completed-wave unlocks. Contact us if you need assistance. Platform backups may require separate removal or management and may restore local records; uninstalling alone may not remove all backups.
Depending on your circumstances and applicable law, you may also have rights to access information, correct inaccuracies, restrict processing, receive certain information in a portable format, and object to processing based on legitimate interests. Where processing relies on consent, you may withdraw it without affecting earlier lawful processing. We respond within the applicable legal time limits.
You can complain to the UK Information Commissioner’s Office at https://ico.org.uk/make-a-complaint/. You may also have the right to contact your local data protection authority.
11. Children and security
Players must follow the game’s published age rating and Meta’s applicable account and parental-supervision requirements. If you believe a child has supplied personal information to us inappropriately, please contact us so we can investigate and take appropriate steps, including deletion where required.
We use reasonable organisational and technical measures appropriate to the information we handle. No system can guarantee absolute security.
12. Changes and contact
We will update this policy when our practices or legal obligations change and revise the date below. Where required, we will provide additional notice or obtain consent before introducing materially different processing.
For support concerning your information, access requests, objections or deletion requests, contact S McCabe BIM Solutions Ltd., publishing as SMCGaming, using the privacy contact details above.
